Lucas Bersamin, the newly appointed Executive Secretary, was a former Chief Justice of the Supreme Court
An executive secretary is the highest-ranking officer in the President's Office, thus the nickname "Little President"
Some of his tasks under the Administrative Code of the Philippines, notably Book III Chapter 9 Section 27, include directly helping the President in the management of government matters.
He is also entrusted with carrying out presidential directions, orders, and decisions, as well as making decisions for and on behalf of the President on subjects that do not require his immediate presidential attention.
Bersamin is the second chief justice to serve as executive secretary, but he is the first to do so after leaving the bench. During the 1950s, the first was Fred Ruiz Castro. In 1976, he was appointed Chief Justice.
Who exactly is Lucas Bersamin?
Bersamin graduated from the University of the East Law School and finished ninth in the 1973 Bar Exams with an 86.3 percent average.
In 1974, he began his legal career as a private practitioner.
On November 5, 1986, President Corazon Aquino assigned him to the Quezon City Regional Trial Court, beginning his nearly three-decade tenure in the judiciary.
He was awarded the Best Decision in Civil and Criminal Law in 2000. Then, in 2002, he was awarded the Chief Justice Jose Abad Santos Award for Judicial Excellence.
He was appointed as an associate member of the Supreme Court by then-President Gloria Macapagal-Arroyo in 2009.
President Rodrigo Duterte named him as the 25th Chief Justice of the Supreme Court in 2018.
Following his term in the judiciary, Duterte selected Bersamin as head of the Government Service Insurance System (GSIS).
Notable Supreme Court rulings
Bersamin was a part of the 2019 judgement that denied former senator Leila de Lima's plea for a writ of habeas corpus against President Rodrigo Duterte.
Except for a regular complaint in court, the Supreme Court stated that the Constitution offers remedies for breaches committed by a sitting President.
Bersamin wrote the ruling that granted former President and currently Pampanga congresswoman Gloria Macapagal-demurrer Arroyo's to evidence, resulting in her release from incarceration.
Bersamin authored the historic opinion in De Castro vs. Judicial and Bar Council, which confirmed the nomination of then-Associate Justice Renato Corona as Chief Justice. The high court ruled in 2010 that vacancies on the Supreme Court—the 14 justices and the Chief Justice—are not subject to the appointment restriction enshrined in Section 15 of Article VII of the 1987 Constitution.
He also wrote the judgement that permitted former Senate President Juan Ponce Enrile to post bond despite the fact that he was charged with a non-bailable felony of plunder.
He was also the author of the judgement that declared the Disbursement Acceleration Program funding illegal.
