Nintendo Sues Genki Over Switch 2 Mockups – What REALLY Happened

Nintendo Protects IP Once Again - Fake Switch 2 Display Sparks Legal War
Nintendo has filed a lawsuit against accessory manufacturer Genki for trademark infringement, unfair competition, and false advertising after the company displayed unauthorized mockups of the Nintendo Switch 2 at CES 2025 before its official reveal. The controversy began in January when Genki showcased what it claimed was an "exact" physical replica of the Nintendo Switch 2, complete with 3D-printed mockups and a video rendering featuring Nintendo's trademarks. Genki's CEO, Edward Tsai, conducted media interviews claiming the company had based its mockups on an authentic Switch 2 unit and even revealed details about eight accessories they were developing for the unreleased console.

Nintendo's lawsuit specifically targets Genki's unauthorized use of Nintendo's trademarks, including the "Nintendo Switch" and "Joy-Con" branding in their CES 2025 display and marketing materials. The legal complaint alleges that Genki "demoed and promoted unauthorized purported mockups and renderings of the Nintendo Switch 2 and its accessories" featuring Nintendo's protected trademarks and trade dress. Additionally, Nintendo claims Genki infringed on their Nintendo Direct trademark by emailing their mailing list about holding their own "Direct" presentation on April 1st, 2025.

The lawsuit seeks several remedies, including a court order to halt Genki's marketing and sales of Switch 2-related products, destruction of all products and advertising materials using Nintendo's trademarks, return of profits from related sales and coverage of damages and legal costs, a permanent injunction preventing Genki from continuing such practices, and a jury trial to resolve the dispute if a settlement isn't reached.

Genki's inconsistent claims about their access to the Switch 2 are at the center of Nintendo's legal complaint. The situation escalated when Genki's CEO posted on social media with the caption "Genki ninjas infiltrate Nintendo Kyoto HQ," which Nintendo claims was an apparent attempt to further confuse the public.
